This agreement applies to every font you license from Nurf Designs. A copy, with a certificate listing your fonts and license, is attached to your order email. Please read it carefully and keep it with your font files.
1Agreement
This End User License Agreement ("Agreement") is a binding contract between you, the person or organisation named as the licensee on the invoice ("you"), and Nurf Designs, an independent type foundry based in Serang, Banten, Indonesia ("Nurf Designs", "we"). It applies when you buy, download, install or use any font from Nurf Designs.
Please read the whole Agreement before you use the font, and keep a copy with your font files. If you do not agree with it, do not download, install or use the font.
2Definitions
- "Font" means the font software you licensed, in any format or version, including its outlines, code and accompanying files.
- "License Tier" means the license you chose at checkout (Standard, Business, Extended, Corporate or Agency) or a custom license agreed with Nurf Designs in writing. The limits of each tier are listed at nurfdesigns.com/licensing and on your license certificate.
- "User" means one person who installs or uses the Font on one computer or device.
- "Invoice" means the invoice issued for your order. It is your proof of license.
3License
Once your payment has been received in full, Nurf Designs grants you a non-exclusive, non-assignable and non-transferable license to install and use the Font within the limits of your License Tier, subject to all the terms of this Agreement.
The limits of your License Tier (number of Users, website page views, printed or promotional units, brand logos, digital ad impressions, e-books, video and app titles) apply together. If your use grows beyond them, you must upgrade your license before you continue. You have no rights to the Font other than those set out in this Agreement, and all rights not expressly granted are reserved by Nurf Designs.
4What you may do
- Install the Font on the number of computers allowed by your License Tier.
- Use the Font in artwork, printed materials, packaging, websites, social media and other designs, within the limits of your License Tier.
- Use the Font on merchandise and products for sale, such as clothing, textiles, ceramics and packaging, as long as the number of units stays within the printed or promotional units of your License Tier.
- Embed the Font in a secure electronic document, such as a PDF, only so that it can be viewed and printed.
- Give a copy of the Font to a commercial printer or service bureau only to produce a document of yours. They must destroy every copy when the work is done.
- Make one (1) back-up copy of the Font for archiving, and keep it protected against access by others.
5What you may not do
- Share, sell, rent, lease, lend, give, sublicense or otherwise distribute the Font or any copy of it, except as allowed above.
- Upload the Font to public websites, file-sharing services, design platforms or other tools where other people can access or use it.
- Include the Font in a commercial product from which it can be extracted or used by others, such as templates, themes or software, without a License Extension.
- Embed the Font in an electronic document that can be edited by its recipient, or in apps, games, servers, video or broadcast beyond what your License Tier allows, without a License Extension.

6Modifications
You may not adapt or modify the Font, change its spacing or kerning, add, remove or change characters, create additional weights, or create derivative fonts from the Font or any part of it, without written permission from Nurf Designs.
7Ownership
Nurf Designs owns all right, title and interest in the Font, its structure, organisation, code and related files, including all copyright, design and trademark rights. The Font is licensed to you, not sold. Any use of the Font not permitted by this Agreement infringes these rights.
8Updates and pricing
Nurf Designs may update the Font from time to time. Upgrade pricing may apply to updates and to moving to a higher License Tier.
9Limited warranty and refunds
Nurf Designs warrants that the Font will be free from defects in materials and workmanship under normal use for 30 days from the date of delivery shown on your invoice. If a defect appears in that period, we will replace the Font, and the replacement is warranted for 30 days. This warranty does not cover failures caused by accident, abuse or misapplication.
Because fonts are delivered instantly as digital files, payments are not refundable, except where a refund is required by law or offered by Nurf Designs at its discretion.
10Limitation of liability
Apart from the warranty above, the Font is provided "as is". To the extent permitted by law, Nurf Designs will in no event be liable for any damages, including lost profits or lost savings, arising from the use of or inability to use the Font.
11Unlicensed use
A license is valid only after purchase. Using the Font commercially without a license, or beyond the limits of your License Tier, is copyright infringement. Violations are charged a fine of USD 7,000 or handled under the applicable law of Indonesia.
12Termination
This Agreement ends automatically if you, or anyone acting for you, fail to comply with it. When it ends you must stop using the Font and destroy all copies, including back-up copies.
13Governing law
This Agreement is governed by the laws of the Republic of Indonesia.
